Legal status

The National Centre of Legislative Activity under the Auspices of the President of the Republic of Belarus (hereinafter also referred as - Centre) is the central official body providing for the preparation of drafts legal normative acts (hereinafter also referred as - draft acts)  in the Republic of Belarus. The Centre has been formed in accordance with the Edict of the President of the Republic of Belarus from 28 July 1997 No 407 “On Creation of the National Centre of Legislative Activity under the Auspices of the President of the Republic of Belarus” on basis of the former Belarusian Institute for State Development and Legislation. The establishment of the Centre dates from 1 November 1997.

The personnel of the Centre numbers 75 highly professional lawyers and combines long-term experience of practitioners with academic knowledge of experts having academic degrees, as well as with creative potential of young employees. Nowadays, 7 employees of the Centre have a doctor’s degree, 7 employees are working on theirs dissertations to take a doctor of law degree, 8 employees are in possession of two higher educations.

 Competence
  • developing concepts on improvement of the legislation, State programs of preparation of drafts of legal normative acts, annual plans of preparation of draft laws and submitting them in due order for approval by the President of the Republic of Belarus, carrying out the control over realization of the above mentioned programs and plans;
  • performing methodical guidance of preparation of drafts of legal normative acts in the Republic of Belarus;
  • elaborating directly drafts of legal normative acts, with the exception of drafts, the preparation of which is assigned to other State bodies (organizations), and working up drafts of international treaties, other international legal acts, the preparation of which is assigned to the Centre;
  • taking measures on bringing legal normative acts in conformity with the Constitution of the Republic of Belarus, decisions of the President of the Republic of Belarus, laws, legal normative acts of a higher legal force;
  • implementing an obligatory legal expert examination of the drafts laws to be submitted to the House of Representatives of National Assembly of the Republic of Belarus, of amendments and (or) additions into draft laws brought by the House of Representatives of National Assembly of the Republic of Belarus;
  • carrying out analytical and scientific researches with the purpose of ensuring the rule-making activity;
  • cooperating with State bodies, scientific organizations, other legal and physical persons, as well as with international organizations on issues within the competence of the Centre;
  • undertaking due actions on systematization of the legislation, and also to provide preparation and conducting of the Statutes at Large (Code of laws) of the Republic of Belarus;
  • studying the application practice of legal normative acts and forecasting consequences of their adoption (edition);
  • summarizing and introducing advanced technologies of preparation of drafts legal normative acts in the Republic of Belarus;
  • organizing activities on improvement of professional skills of officials who belong to the staff of legal services of State bodies (organizations) dealing with issues of rule-making activity;
  • giving commentaries on issues of application of the legislation regulating the rule-making activity;
  • preparing draft legal normative acts, including international treaties and other international legal arrangements on the basis of orders from State bodies of the Republic of Belarus and from foreign States, as well as from international organizations; implementing analytical and scientific researches;
  • carrying out other functions stipulated by legal regulations.

In order to implement its functions the Centre is entitled:

  • in compliance with the legislation, to request and to receive in established way from the State bodies, legal and physical persons the documents being necessary for the realization of activity of the Centre;
  • to use State (including governmental) postal and communication facilities and communications;
  • to conclude within the frames of its competence contracts with State bodies, legal and physical persons, and also with international organizations;
  • to form analytical and other working groups for carrying out of scientific researches at the Centre and realization of other powers of the Centre.
